WHO WE ARE AND WHAT THIS LICENCE DOES?
We are PCC of Hook Parish acting on behalf of Whitewater Benefice and these are our terms and conditions. If you agree to these terms and conditions, then we will permit you to:
YOUR PRIVACY
We only use any personal data we collect through your use of the Services in the ways set out in our privacy policy Privacy Policy. Our Privacy Policy tells you what personal data we collect from you, what we do with it and who we may share it with. It is important that you read this document as it also sets out your rights in relation to the personal information that we hold about you.

We take the security of your information very seriously and have put into place appropriate measures to ensure the safety and security of any personal data that you or we input into the Services. However, it is your responsibility to ensure that the device you use to access the Services is adequately protected against threats or harmful programs.

The ways in which you can use the Services may also be controlled by the rules and policies of your Appstore. Their rules and policies will apply instead of these terms where there are differences between the two and so you should read these before use.

Contacting us (including with complaints). If you wish to discuss any issues with the Services or want to contact us for any other reason, please contact us using the details on our website.

How we will communicate with you. If we have to contact you with any issues relating to our Services or to provide you with any other information relating to our church and its activities, we will do so by in person, on the phone or by email using the contact details you have provided to us. We will only contact you with information directly related to us and the activities of our church and its community unless you inform us to stop.

USE OF THE SERVICES
In return for you agreeing to comply with these terms you may:

USE BY MINORS
You must be 13 or over to accept these terms. However, we do permit any person aged 13 or over to set up an account with the permission of their parent or guardian. We will ask for confirmation of permission at the time of setting up the account. We may verify this with the parent or guardian of the minor and it is the responsibility of the parent or guardian to supervise the use of the Services by their child.
We will do our best to assess any possible risks for users (and in particular, for children) from third parties when they use any interactive service provided as part of the Services, and we will decide in each case whether it is appropriate to use moderation of the relevant service (including what kind of moderation to use) in the light of those risks. However, we are under no obligation to oversee, monitor or moderate any interactive service we provide on our site, and we expressly exclude our liability for any loss or damage arising from the use of any interactive service by a user in contravention of our content standards, whether the service is moderated or not.

The use of any of our interactive services by a minor is subject to the consent of their parent or guardian. We advise parents who permit their children to use an interactive service that it is important that they communicate with their children about their safety online, as moderation is not fool proof. Minors who are using any interactive service should be made aware of the potential risks to them.

CHANGES TO THESE TERMS
We may need to change these terms to reflect changes in law or best practice or to deal with additional features which we introduce. Please check these terms regularly as they may have changed.

UPDATES AND CHANGES
From time to time we may update and/or change the Services to improve performance, enhance functionality, reflect changes to the operating system or address security issues. If you choose not to install such updates or if you opt out of automatic updates you may not be able to continue using the Services.

COLLECTING TECHNICAL DATA
By using the Services, you agree to us collecting and using technical information about the devices you use and related software, hardware and peripherals. This information may be used by us or our data processors to improve our products and to provide any Services to you. This will not include any personal data about you.

OTHER WEBSITES
The Services may contain links to other independent websites which are not provided by us. Such independent sites are not under our control, and we are not responsible for and have not checked and approved their content or their privacy policies (if any).

You will need to make your own independent judgement about whether to use any such independent sites, including whether to buy any products or services offered by them.

INTELLECTUAL PROPERTY RIGHTS
All intellectual property rights in the Services throughout the World belong to us (or our licensors) and the rights in the Services are sub-licensed (not sold) to you. You have no intellectual property rights in the Services other than the right to use them in accordance with these terms.

OUR RESPONSIBILITY
We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees or representatives or for fraud or fraudulent misrepresentation.
We are responsible to you for foreseeable non-commercial loss and damage caused by us. If we (or our data processors) fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or our failing to use reasonable care and skill, but we (and our data processors) are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time you accepted these terms, both we and you knew it might happen. Our Services are for domestic and private use in relation to your attendance at our church and participation in our community and so we will not be liable for any business losses however caused.

Limitations to the App and the Services. The Services are provided for general information purposes only. They do not offer advice on which you should rely except where we expressly state otherwise. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of information obtained whilst using the Services. Although we make reasonable efforts to update the information provided by the Services, we (and our data processors) make no representations, warranties or guarantees, whether express or implied, that such information is accurate, complete or up to date.

Check that the App and the Services are suitable for you. The Services have not been developed to meet your individual requirements. Please check that the facilities and functions of the Services meet your requirements.

We are not responsible for events outside our control. If our provision of the Services is delayed by an event outside our control then we will use reasonable endeavours to contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. We will not be responsible for any losses incurred for events outside our control.

ENDING YOUR USE
We may end your rights to use the Services at any time by contacting you if you have broken these terms in a serious way. If what you have done can be put right we will give you a reasonable opportunity to do so.

If we end your rights to use the Services:

NO RIGHTS FOR THIRD PARTIES
With the exception of Edit Websites Limited who may enforce any of the terms, this agreement does not give rise to any rights under the Contracts (Rights of Third Parties) Act 1999 to any third party to enforce any of its terms.

WHICH LAWS APPLY TO THIS CONTRACT AND WHERE YOU MAY BRING LEGAL PROCEEDINGS
This Licence shall be governed by and construed in accordance with English law and each party hereby submits to the non-exclusive jurisdiction of the English courts.
